Product prices are expressed in euros including VAT and shipping costs.
Regardless of the country of origin, all orders are payable in euros. Twing’Auto reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in force at the time the internet user places the order.

 

 

Orders are placed online. By clicking on the “Buy” button, the buyer declares that they accept these T&Cs. The data saved by twingauto.fr constitutes proof of all past transactions. Once the order has been placed, the customer must send the faulty gear stick to the following address: Garage Marion occasions, 10 rue Victor Hugo 50320 saint jean des champs. Upon receipt of your gear stick, twingauto.fr will send you the new gear stick within 24 hours.

 

 

Twingauto.fr may authorise direct shipment of the new gear stick after the customer has paid a deposit of €89.00 including VAT at the time of ordering. The customer will have 15 days to return the faulty gear stick in order to get the deposit back.

 

 

In accordance with Articles L.121-18-4 and L.121-20 of the French Consumer Code, the buyer has a right of withdrawal that can be exercised within fourteen (14) working days from receipt of the delivered goods. The legal right of withdrawal must be exercised without having to justify the reason or pay any penalties. In accordance with Article L.121-20-1 of the French Consumer Code, if the buyer exercises their right of withdrawal, Twingauto.fr undertakes to refund the total amount paid, with the return of the product being at the buyer's expense.

 

 

Refunds will be made by bank cheque addressed to the name of the customer who placed the order and to the billing address or by bank transfer depending on the initial payment method used, at the latest within thirty (30) days following the date on which the buyer exercised their right of withdrawal, subject to prior receipt by twingauto.fr of the item in question in accordance with the conditions provided below. If twingauto.fr wishes, the buyer who has exercised their right of withdrawal may choose another refund method. In the event that the legal right of withdrawal is exercised, the buyer must return the item in question at their own expense, in its original packaging, undamaged, together with any accessories. If the item is returned incomplete or damaged, twingauto.fr may refuse to process the refund or apply a discount.

 

If the product ordered is not available, or if the customer does not accept the delivery time imposed by this non-availability, twingauto.fr may offer a replacement product to the customer who is free to accept or refuse it. In case of unavailability of all or part of the order, and refusal of the delivery time or replacement products by the customer, the refund will be made by bank cheque sent to the name of the customer who placed the order and the billing address or by crediting the customer’s credit card depending on the payment method used at the latest within thirty (30) days from the payment of the amount paid by the customer. Twingauto.fr will not be held responsible for the non-fulfilment of the contract concluded in the event of stock shortage or product unavailability, force majeure, disruption or total or partial strike particularly of postal services and means of transport and/or communication, flood or fire. Twingauto.fr will not be held responsible for any indirect damage due to the present, operating loss, loss of profit, damage or expenses, which could arise from the purchase of products.

 

In accordance with the Article L.144-1 of the French Consumer Code, if the buyer has not received the product within seven (7) days following the expected delivery deadline, they may cancel their order by registered letter with requested acknowledgement of receipt. The seller then undertakes to refund the amount that the buyer has paid in connection with their order under the conditions set out in Article L.121-20-1 of the French Consumer Code. However, if the buyer has received the product after the deadline and decides to cancel their order in accordance with the conditions set out in this paragraph, the refund will only be made subject to the product in question being received by the seller. If the item is sent back incomplete or damaged, the seller may refuse to refund or apply a discount. Delivery times are calculated in working days and are extended until the next working day for orders placed after 6pm, as well as for orders placed on a Saturday, Sunday, bank holiday or non-working day. Products purchased on twingauto.fr are delivered in mainland France (including Corsica). Products are delivered to the delivery address given by the buyer when ordering. The processing period for an order is made up of the preparation time (the majority of orders are processed within 48 hours) and the delivery time, which depends on the chosen carrier. Twingauto.fr can’t be held responsible for the consequences of a delay in delivery. The buyer is responsible for checking the condition of the packaging and the products on delivery. If the parcel is damaged on delivery, the buyer may refuse it and not sign the delivery note without making any specific reservations (anomaly, damaged product etc.). They should also confirm the reservations to the carrier at the latest within two (2) working days following receipt of the item(s) and send a copy of this letter to the seller.

 

All products displayed on twingauto.fr benefit from a 3-month warranty for used parts and a 1-year warranty for new parts. In order to be able to benefit from the product warranty, the buyer must keep the product purchase invoice. Generally, and unless there is prior, express and written exemption from twingauto.fr, warranties do not cover:
• abnormal or non-compliant use of products.
• defects and their consequences linked to use which doesn’t comply with the use for which the product is intended (competition etc.).
• defects and their consequences linked to any external cause.

 

This contract is subject to French law. The language of this contract is French. 
In the event of a dispute, the Avranches (Manche - France) courts shall have jurisdiction.

 

These Terms and Conditions govern the contractual relationship between twingauto.fr, and the buyers, both parties accepting them without reservation. These Terms and Conditions shall prevail over any other conditions contained in any other document, unless there is prior, express and written exemption from twingauto.fr. These general and specific Terms and Conditions of sale may be modified at any time and without prior notice. They are applicable in mainland France, including Corsica. For products to be delivered outside of France, please contact us.

 

Twingauto.fr reserves the right to refuse to honour an order from a consumer who has not paid in full or in part for a previous order or with whom a payment dispute is being administered. Within the framework of these procedures, our services may have to ask you for all the documents necessary for the release of your order.
